General

By confirming the order, the customer agrees to the terms and conditions specified below.

Buyer

For the purposes hereof, the term “Buyer” means any natural person, sole trader, or legal entity that purchases goods from the Seller.

Purchase Agreement

Orders placed via www.modelovedomeckyspalek.cz are considered binding. By submitting an order, the Buyer confirms that the Buyer has read and agrees to the terms and conditions and the customer complaints code.

The data provided by the Buyer must be true and accurate.

By completing the order form, the Buyer agrees the Seller may use the provided data to dispatch the order. The Seller may use the data only for the purposes associated with the processing of the order.

The electronic order form filled in by the Buyer constitutes a draft purchase agreement. The purchase agreement is entered into when the Buyer collects the goods ordered from the Seller.

The title to the goods passes to the Buyer after the purchase price is paid, the transport costs are covered and the goods are collected.

The goods will be delivered to the shipping address specified by the Buyer in the order form. If the Buyer specifies only the billing address, it will be at the same time used as the shipping address.

Customer Complaints Code

Any complaints will be handled in accordance with the customer complaints code of www.modelovedomeckyspalek.cz and the applicable laws and regulations of the Czech Republic in force when the purchase agreement is entered into.

Purchase Agreement Withdrawal – Returning the Goods

The Buyer may withdraw from the purchase agreement within 14 days of receipt of the goods. In such event, the Buyer shall send the goods back undamaged, without signs of use or wear, in their original packaging within the specified period (based on the date the order was shipped). The goods cannot be returned via cash on delivery parcel. Upon receipt of the returned goods, the Seller will promptly refund the corresponding amount to the Buyer in the manner the parties had agreed on. The Seller will not cover the expenses associated with the shipment of the goods. The claimed amount will not be refunded until the claimed goods are delivered back to the Seller.

Purchase Agreement Withdrawal by the Seller

The Seller reserves the right to cancel the order or any of its parts if the ordered goods are no longer being produced or distributed. In such event, the Buyer will be contacted immediately and the parties will agree on the next steps. If the Buyer has already paid the purchase price or its part, the paid amount will be refunded.

Claim Procedure

Damaged Parcel

  • If the parcel is opened, damaged or otherwise deformed, take photos documenting its current state.
  • Describe the problems in writing with the photos attached and send it via email to domeckyspalek@gmail.com
  • Leave the parcel unopened until you are asked to recheck the contents either by the Seller or the carrier.
  • If the carrier takes responsibility, the money will be refunded.

Returning the Goods

  • Email/call the Seller.
  • The parties will agree on the way the goods will be returned.
  • Send the goods to the Seller’s address. If the goods are undamaged, the claim will be accepted (this does not apply if the goods are claimed due to damage).
  • If the applicable eligibility conditions are fulfilled, the money is returned to the account from which the payment was made; if the payment was made by bank transfer or credit card, the money will be sent to the account specified by the Buyer.

The Goods Have Not Arrived

  • Email/call the Seller.
  • The order will be checked through the tracking code and the carrier will initiate its tracking.
  • If the carrier accepts responsibility for the loss of the parcel, the money is refunded to the Buyer.

Denial of Claims

The claim will be denied if the goods are returned in a condition that does not match the condition when being shipped (most of the parcels are photographed before they are handed over to the carrier).

Shipping Options

The Buyer shall cover the costs associated with the shipping of the goods. All costs are calculated when the order is being created. If the price of the order exceeds CZK 2,000, the shipping costs will be covered by the Seller.

The Buyer can currently choose between two carries:

  • Zásilkovna
  • Česká pošta

Zásilkovna

Based on the weight of the goods, the Seller will decide on an appropriate parcel packaging option. The parcel is insured against loss or damage during transportation.

Česká pošta

Based on the weight of the goods, the Seller will decide on an appropriate parcel packaging option. The parcel is insured against loss or damage during transportation.

Česká pošta can only be used for shipping within the Czech Republic.

International Shipping

If the goods are shipped internationally, the Buyer shall pay any additional fees associated with the shipping (e.g. customs duty).

Payment Options

Bank Transfer

The Seller will provide the Buyer with all payment instructions, including the reference number.

Dispute Resolution

Alternative dispute resolution for consumer disputes is in the jurisdiction of the Czech Trade Inspection Authority (CTIA) with its registered office at Štěpánská 567/15, 120 00 Prague 2, Company number: 000 20 869, https://www.coi.cz/en/. The online dispute resolution platform at http://ec.europa.eu/consumers/odr can be used to resolve disputes between the Seller and the Buyer under the purchase agreement.

Pursuant to Regulation (EU) no 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on consumer ODR), the European Consumer Centre (ECC) with its registered office at Štěpánská 567/15, 120 00 Prague 2, https://evropskyspotrebitel.cz/en/ shall act as the contact point.

Final Provisions

The Seller declares that all personal data will only be used for the purposes associated with the performance of the purchase agreement with the Buyer and not otherwise disclosed to any third party, except in situations related to the distribution of and transactions concerning the ordered goods.

These terms and conditions are valid as of 11 September 2021. The Seller reserves the right to update the terms and conditions without prior notice.
